International Collaboration

In line with other European Union Member States, Romania - through its law enforcement authorities - carries out an excellent collaboration in the police field, aiming to ensure the security of the European area and of the citizens and to counter the cross border crime, respectively.

The Romanian Border Police - as a specialized institution of the Ministry of Administration and Interior-, pays constant attention to the enhancement of the international police cooperation (at European level and not only), fully aware of the fact that, a rapid and efficient countering of the illicit deeds committed in more than one state, is possible only through an operative exchange of data and information and through participating in joint operations for the complex cases.

The European provisions on police cooperation are also applied, the aim of the Romanian Border Police being the efficient prevention and countering of the cross border crime.

The international police cooperation channels used by the Romanian Border Police are:

  • the exchange of information carried out through the contact points and centers set up at the border;
  • the exchange of information carried out directly through the liaison officers / home affairs attaché appointed by other states in Romania;
  • the exchange of information carried out through the liaison officers / home affairs attaché appointed by Romania in other states;
  • the exchange of information carried out through the agency of the International Police Cooperation Center - M.A.I.;
  • the exchange of information through FRONTEX;
  • the exchange of information carried out with the similar structures in other states, on the basis of bilateral documents to which Romania is part of / protocols concluded at institutional level.
  • In accordance with the bilateral documents to which Romania is part of and on the basis of the existing cooperation plans, periodical reunions are organized among the chiefs of the border police structures from the neighboring states, visits and experience exchange at the level of experts, as well as border mixed meetings at the level of the border commissioners also, in order to improve the cooperation for strengthening the security of the common borders.

The main legal instruments for cooperation are:

  • the international treaties and conventions;
  • the border treaties;
  • the documents which establish the international operational cooperation in the fight against cross border and organized crime, concluded at bilateral and multilateral level.

International Collaboration

 

Collaboration with the Austrian Republic

  • Agreement between the Romanian Government and the Austrian Federal Government regarding the mutual exchange of data in the field of migration and asylum problems, signed at Bucharest, on 24 of June 2004;
  • Convention in administrative plan between the Ministry of Administration and Interior of Romania and the Federal Ministry of Interior of Austrian Republic regarding the practices of simplified application of the Regulation C.E. No. 343/ 2003 of the Council of 18 th of February 2003 regarding the establishment of the criteria and mechanism to settle the state responsible for the examination of asylum request made in a Member State by a third country citizen - July 2007;
  • Agreement between the Romanian and Austrian Government regarding the cooperation in fighting against organized crime, international illegal trafficking in drugs, international terrorism as well as for other purposes in the field of criminal justice, concluded at Bucharest, on 18.03.1999;
  • Understanding regarding the enhancement of the collaboration between the Romanian Ministry of Interior and the Federal Ministry of Interior of Austrian Republic, in the field of countering illegal migration and international organized crime, signed at Vienna, on 28 th of November 2001;
  • Agreement between the Romanian Government and the Federal Government of the Austrian Republic regarding the persons' readmission and the Protocol for the implementation of the Agreement, signed at Vienna, on 28 th of November 2001.

Collaboration with the Republic of Bosnia and Herzegovina

  • Agreement between the Romanian Government and the Council of Ministers of Bosnia and Herzegovina regarding the readmission of own citizens and of the aliens, signed in Bucharest , on the 11th of October 2005, ratificated by Law No 59/22 March 2006;

  • Convention for the delimitation of the river border on the Danube, signed on 1/14.01.1908, between Romania and Bulgaria.
  • Friendship, collaboration and good neighbouring Treaty between Romania and Bulgaria, signed at Sofia, on 27.01.1992.

  • Enlarged trilateral cooperation Protocol in countering criminality and especially the cross-bordering criminality, between Romania, Bulgaria and Greece, signed at Sofia, on 08.09.1998.
  • Agreement between the Romanian and Bulgarian Government regarding the readmission of the own citizens and of the foreigners, signed at Bucharest, on 23.06.2000.
  • Cooperation Agreement between the governments of the states participating in the Economic cooperation of the Black Sea in the field of the countering criminality, especially of its organized forms, concluded at Kerkyra, on 02.10.1998.
  • Cooperation Agreement for the prevention and countering cross - bordering criminality, concluded between the government of Romania, Albania, Bosnia- Herzegovina, Bulgarian Republic, Greece, Hungary, Macedonia, Moldavian Republic and Turkish Republic, signed at Bucharest, on 26.05.1999.

Collaboration with the Chech Republic

  • Law no. 465 / 09.07.2002 ratifying the Agreement between Romania and Check Republic regarding the cooperation in countering organized crime, illegal trafficking in drugs, psychotropic substances and substitutes, terrorism and other serious crimes, signed on 13 th of November 2001;
  • Decision of the Romanian Government no. 154/1994 for the approval of the Understanding of Collaboration between the Romanian Ministry of Interior and the Ministry of Interior of Check Republic, signed at Prague, on 25 th of January 1994;
  • Government Decision for the approval of the Agreement between the Romanian Government and the Government of the Check Republic regarding the handing and taking over persons who entered or stayed illegally of the territory of the other state.

Collaboration with the People's Republic of China

  • Convention between the Romanian Government and the Government of the People's Republic of China regarding the handing over and receiving of the persons, who had entered or stayed illegally on the territory of the other state - the Romanian Project of the Convention was submitted to the Ministry of Foreign Affairs in order to be sent to the Chinese party, requiring proposals in connection to the time and place for the negotiations.

Collaboration with the Republic of Croatia

  • Agreement between the Romanian Government and the Government of Croatian Republic with respect to cooperation in countering terrorism, organized crime, illegal trafficking with drugs and psychotropic substances as well as other illegal activities, signed at Zagreb, on the 30th of September 2000;
  • Agreement between the Romanian Government and the Government of Croatian Republic with respect to readmission of own citizens and aliens, signed at Zagreb, on the 30th of September 2000.

Collaboration with the Republic of France

  • Pursuant to the "Protocol regarding the enhancement of bilateral cooperation in order to fight against organized crime, trafficking in human beings and to assure the internal security of the two countries", signed at Bucharest, on 30 August 2002, by the Romanian and French minister of interior, in Oradea it was established a Contact Point specialized in the exchange of data and intelligence regarding the illegal migration, trafficking in stolen vehicles and forged or falsified travel documents.
  • Agreement between the Romanian and the French Government regarding the cooperation for the protection of the under aged Romanians who are in difficulty on the territory of the French Republic and their return in the country of origin, as well as for the fight against exploiting networks, signed at Paris, on 4 October 2002, approved by the G.D. no 1295/2002.
  • Agreement between the Romanian Government and French Government regarding the readmission of the illegal persons, signed at Bucharest , on the 12th of April 1994;
  • Agreement between the Romanian Government and French Government regarding home affairs cooperation, signed at Bucharest , on the 21st of February 1997;
  • Collaboration protocol between the ministers of interior of Romania and France with respect to enhancing the bilateral cooperation in the fight against organized crime, trafficking in human beings and homeland security of the two countries, signed at Bucharest, on the 10th of January 2005;
  • Agreement between the Romanian Government and French Government with respect to cooperation for the protection of the underage Romanians who are in difficulty on the territory of French Republic and their return to the origin country, as well as for the fight against the exploiting networks, signed at Bucharest, on the 1st February 2007.

Collaboration with Federal Republic of Germany

  • Understanding between the Romanian Intelligence Service, the Ministry of Administration and Interior in Romania and the Federal Ministry of Interior of the Federal Republic of Germany regarding the cooperation in the field of missions carried out by the armed assistants for the security of the civil flights between Romania and Federal Republic of Germany, signed at Berlin, on 17.05.2006 and at Bucharest, on 23.05.2006;
  • Convention between the Ministry of Interior of Romania and the Federal Ministry of Interior of the Federal Republic of Germany regarding the taking over of the Romanian and German citizens, signed at Bucharest , on the 24th of September 1992;

  • Agreement between the Romanian Government and the Government of the Hellenic Republic regarding the readmission of the person in illegal situation, signed at Athens, on 06.06.1994;
  • Protocol of Trilateral Cooperation for Countering Cross-bordering Criminality concluded between the Romanian Government, the Government of the Bulgarian Republic and the Government of the Hellenic Republic, signed at Sofia, on 08.09.1998.

Collaboration with the Republic of Macedonia (FYROM)

  • Law No 193 of 25 May 2004 on the ratification of the Agreement between the Romanian Government and the Government of the Republic of Macedonia on the readmission of their own citizens and aliens, signed in Bucharest, on 12 November 2003.

Collaboration with the Italian Republic

  • Treaty of friendship and collaboration between Romania and Italian Republic, signed at Bucharest , on the 23rd of July 1991;
  • Memorandum of Understanding between the Ministry of Administration and Interior in Romania and the Ministry of Economy and Finances in Italy in matters of intelligence cooperation in the fight against economic - financial criminality, signed on the 14 th of December 2005, at Bucharest - approved by GD No 178/09.02.2006, published in the Official Gazette No 158/20.02.2006, came into force on 29.03.2007;
  • Agreement between Romania and Italy regarding the readmission of the illegal persons, signed at Bucharest , on the 4th of March 1997. The document ratified by law no 173/04.11.1997, published in the Official Gazette no 304/07.11.1997, came into force on 1st of February 1998 with undetermined validity;
  • Understanding for implementing the Agreement between Romania and Italy regarding the readmission of the illegal persons, signed at Bucharest , on the 15th of April 1997. The agreement came into force in the same time with the Readmission Agreement;
  • Collaboration protocol between the Ministry of Administration and Interior in Romania and the Ministry of Interior in Italy, signed at Bucharest at the 19th of December 2006. The Romanian side has concluded the internal procedures required for coming into force, being approved by GD 327/28.03.2007 (OG 240/06.04.2007) and the Italian side has concluded at the 18 February 2008;
  • Understanding between the Ministry of Administration and Interior of Romania and the Ministry of Interior of Italy regarding the application of the cooperation protocol between the Ministry of Administration and Interior of Romania and the Ministry of Interior of Italy , signed at Bucharest at 19th of December 2006 - signed on the 22nd of November 2008. The Romanian party concluded the internal procedures required for its entering into force, being approved by GD No 182/20.02.2008 (OG 141/25.02.2008).

Collaboration with the Moldavian Republic

  • Agreement between the Romanian and Moldavian Government regarding the citizens’ reciprocal travels, signed at Bucharest, on 20.10.2006.
  • Agreement between the Romanian Government and the Government of the Moldavian Republic regarding the foreigners’ readmission - 27th of July 2001.

  • Protocol between the Ministry of Administration and Interior of Romania and the Ministry of Home Affairs and Border Guard Service of the Moldavian Republic, signed at Bucharest, on the 23rd of March 2006, for implementing the Agreement between the Romanian and

Collaboration with Montenegro Republic

  • Protocol between the Ministry of Administration and Interior of Romania and the Ministry of Home Affairs of Montenegro Republic with respect to police cooperation, signed at Bucharest , on the 25th of August 2006;
  • Agreement between the European Community and Montenegro Republic with respect to the facilitation of the visa issuance and readmission;
  • Agreement between the European Community and Montenegro Republic with respect to the readmission of the persons staying illegally.

Collaboration with the Kingdom of Netherlands

  • Memorandum of Understanding of 21 of April 2004 between the Ministry of Administration and Interior in Romania, Ministry of Interior and National Relations and Ministry of Justice in the Kingdom of Netherlands in the field of home affairs.

Collaboration with the Republic of Poland

  • Understanding between the Romanian Government and the Polish Government regarding the mutual taking over of the illegal persons on the territory of one of the Contracting States, signed at Warsaw , on the 24th of July 1993;
  • Protocol regarding the application of the Understanding between the Romanian Government and the Polish Government regarding the mutual taking over of the illegal persons on the territory of one of the Contracting States, signed at Warsaw, on the 24th July 1993;
  • Understanding of collaboration between the Ministry of Interior of Romania and Home Affairs Ministry of Poland, signed at Warsaw , on the 13th of August 1992;
  • Agreement between the Romanian Government and the Polish Government regarding the collaboration in countering the organized crime, terrorism and other crimes, signed at Warsaw, on the 12th of July 2001 - document which has not entered into force because the Polish party has not fulfilled the internal procedures for the entering into force of the agreement.

Collaboration with the Russian Federation

  • Agreement between the Romanian Government and the Government of the Russian Federation on the mutual travelling of citizens, signed on 26 August 2002;
  • Understanding between the General Inspectorate of Romanian Border Police within the Ministry of Administration and Interior and the Federal Border Service of the Russian Federation on cooperation in border issues, document signed on 27 March 2003, in Bucharest;
  • Cooperation Agreement between the governments of the states participating in the Black Sea Economic Cooperation in counteracting crime, especially its organized forms, signed in Keryra, on 02.10.1998;
  • Protocol on fighting terrorism, additional to the Cooperation Agreement between the governments of the states participating in the Black Sea Economic Cooperation in counteracting crime, especially its organized forms, signed in Athens, on 3 December 2004.

Collaboration with Serbia

  • Agreement between the Romanian Government and the Cabinet Council of Serbia regarding the elimination of the compulsory character of visa for the holders of diplomatic and service passports, signed at Bucharest, on 14th of July 2004;
  • Agreement between the Romanian Government and the Cabinet Council of Serbia regarding the citizens’ travelling conditions, signed at Bucharest, on 14th of July 2004;
  • Agreement between People’s Republic of Romania and the Government of the Federative Socialist Republic of Yugoslavia regarding the way to solve some problems of the regime of the Romanian-Yugoslavian state border, signed at Bucharest, on 20.12.1963;
  • Intergovernmental Agreement with respect to the Romanian - Hungarian - Serbian triplex confinium border marker at Beba Veche, signed on the 19th of April 2006;
  • Agreement between the Ministry of Administration and Interior of Romania and the Ministry of Home Affairs of Serbia regarding the cooperation in the field of countering organized crime, illegal drugs trafficking and international terrorism, signed on the 5th of July 2007;
  • Convention between the Romanian Government and the Cabinet Council of Serbia with respect to the rebuilding, delimitation, marking and maintenance of the border line and markers at the common state border, signed on the 4th of September 2007; the document is in the process of being approved;
  • Agreement between the European Community and Serbian Republic with respect to the facilitation of the visa issuance, came into force on the 1st of January 2008;
  • Agreement between the European Community and Serbian Republic with respect to readmission of the persons staying illegally;
  • Decision No 799 of 14 July 2005 for approving the Agreement between the Romanian Government and the Council of Ministers of Serbia on the elimination of visa requirement for holders of diplomatic and duty passports, signed in Bucharest on 14 July 2004;
  • Decision No 799 of 14 July 2005 for approving the Agreement between the Romanian Government and the Council of Ministers of Serbia on the travel conditions for citizens signed in Bucharest on 14 July 2004.

Collaboration with the Slovakian Republic

  • Agreement between the Romanian Government and the Government of Slovakian Republic regarding the persons’ readmission, signed at Bratislava, on 30 th of June 2005, ratified through the Government Emergency Ordinance no. 84 of 14 th of July 2005, published in the Official Gazette of Romania, Part I, no. 633 of 19 th of July 2005 and approved by the Romanian Parliament through the Law no. 252 of 9 th August 2005.
  • Protocol between the Ministry of Administration and Interior in Romania and the Ministry of Interior of the Slovakian Republic for the implementation of the Agreement between the Romanian Government and the Government of the Slovakian Republic regarding persons’ readmission, signed at Bratislava, on 30 th of June 2005;
  • Agreement between the Romanian Government and the Government of Slovakian Republic with respect to cooperation in countering organized crime, illegal trafficking with drugs, psychotropic substances and precursors, terrorism and other serious crimes, signed on the 16th of October 2003.

Collaboration with the Slovenian Republic

  • Agreement between Romanian Government and the Government of Slovenian Republic regarding the cooperation in the fight against organized crime, illegal trafficking in drugs, psychotropic substances, substitutes, terrorism and other serious crime, signed at Bucharest, on 4 th of October 2000. It entered into force on 17 th of August 2001.
  • Agreement between Romanian Government and the Government of Slovenian Republic regarding the readmission of the persons who entered and stayed illegally on the territory of the states, signed at Bucharest, on 4 th of October 2000 (Official Gazette no. 663/23.10.2001). It entered into force on 5 th of December 2002.

Collaboration with Switzerland

  • Agreement between the Romanian Government and the Swiss Federal Council with respect to the mutual visa abolition, signed at Bern , on the 15th of December 2003, approved by GD no 1.531/18.12.2003;
  • Agreement between the Romanian Government and the Swiss Federal Council with respect to the readmission of persons, signed at Zürich, on the 13th of June 2008, as well as the Implementation Protocol, documents which came into force on the 18th of January 2008;
  • Protocol to the Agreement between the European Community and its Member States, of the one part, and the Swiss Confederation, of the other, on the free movement of persons, regarding the participation, as contracting parties, of the Republic of Bulgaria and Romania pursuant to their accession to the European Union, signed on 27.11.2008, entered into force on 01.06.2009.

Collaboration with the Turkish Republic

  • Cooperation Agreement of 2 October 1998, between the governments of the states participating in the Economic Cooperation at the Black Sea in the field of countering criminality, and specially its organized forms;
  • Cooperation Agreement of 16 April 1998 between the Romanian, Bulgarian and Turkish Government regarding the fight against terrorism, organized crime, illegal trafficking in drugs, psychotropic substances, money laundry, trafficking in guns and human beings and against other serious crimes;
  • Cooperation Agreement of 26 May 1999 regarding the cooperation in the prevention and countering cross-bordering criminality.

Collaboration with the Republic of Ukraine

  • Treaty regarding the relationship of good neighbouring and cooperation between Romania and Ukraine - signed on 02.06.1997, at Constanta.
  • Treaty between Romania and Ukraine regarding the legal regime of the Romanian-Ukrainian state border, the collaboration and the mutual assistance in border matters, signed at Cernauti, on 17 th of June 2003.

FRONTEX Agency

FRONTEX European Agency (European Agency for the Management of Operational Cooperation at the External Borders of Member States of European Union) was founded in 2005 (became operational), under the provisions of Article 2 of Council of Europe Regulation no. 2007 / 2004, having the following objectives:

  • to assure the operational coordination between Member States for the management of external borders;
  • to provide assistance to the Member States in training the border policemen, including by establishing common training standards;
  • to carry out the risk analysis;
  • to follow the development of relevant research for the control and surveillance of the external borders;
  • to provide assistance to the Member States at the external borders and to ensure the support necessary to organize joint operations.

Collaboration with the liaison officers / home affairs attaches

The liaison officers and the home affairs attaches are sent on missions in order to promote and the speed up the cooperation between Romania and the other states, specially, by giving assistance:

  • under the form of exchange of data and information in order to prevent and counter criminality;
  • to answer the requests for police and judiciary assistance in criminal matter;
  • in relation to the attributions of the authorities responsible for the surveillance of the external borders.

The liaison officers and the home affairs attaches have the task to give consultancy and assistance and can not carry out concrete actions in the field of prevention and countering criminality. They provide data and information and exercise their duties in accordance to the instructions received from the competent authorities.

The Romanian Border Police cooperates permanently with:

  • the Romanian M.A.I. liaison officers abroad;
  • the foreign liaison officers who carry out their activity within the accredited diplomatic missions in Romania.

Achieving the cooperation consists in the exchange of intelligence, in the following fields:

  • countering illegal migration;
  • countering trafficking in human beings;
  • countering cross-bordering criminality;
  • countering forgeries in border crossing documents, visas, titles of residence;
  • countering the trafficking in vehicles suspected of having been stolen or erased from circulation
  • identification of the persons with criminal records.

Contact Centres, Offices and Points

The necessity for international cooperation between institutions with border duties as well as other structures involved in countering cross-border crime phenomenon and illegal migration has led to the setting up of contact centers, points and offices, thus, realizing an effective means of international cooperation to prevent and counter cross-border crime in all its manifestation forms: illegal migration, trafficking in human beings, etc.

So, through organizing and functioning rules, the main duties and tasks in the competence of these structures were established, among which:

processing, exchange and transmission of information;
receiving and transmission of assistance requests exchange and answers regarding the prevention and countering illegal acts, as well as providing assistance for the drawing up of such requests;
evaluation of statistic analysis of data and information exchange;
training and assistance regarding the hand over of foreigners based on the readmission agreements.
Since the setting up of the contact centers, points and offices, the normative acts, which underlie their setting up, regulated aspects connected to the competent authorities vested to carry out their activity within these structures, the cooperation forms and methods, data protection, status of the employees and other issues of practical relevance.

The exchange of information consists particularly of data and acts in the activity field of the authorities with border tasks and is subject to the juridical restrictions of the legal provisions on data protection, wanting to diversify the cooperation in the field of home affairs and to provide mutual assistance in different fields.

The outcome of the activities carried out within the cooperation structures contribute efficiently to the increase of prevention and countering capacity in real time of illegal migration, trafficking in human beings and cross-border crime in all its aspects, in order to ensure the security of the state border.
