The Regime Applicable to Small Border Traffic
Small border traffic is carried out in accordance with bilateral agreements concluded by Romania with neighboring third countries in accordance with Regulation (EC) No. 1.931 / 2006 of the European Parliament and of the Council of 20 December 2006 laying down rules on small border traffic at the external land borders of the Member States and amending the provisions of the Schengen Convention.
Small border traffic permits are issued by diplomatic missions and consular offices of Romania in the neighboring third countries with which Romania has concluded agreements in this respect.
The small border traffic permit is the document that entitles the residents of the border area to cross the border of the state, under the regime of small border traffic, according to the Regulation (EC) no. 1.931 / 2006 and on the basis of the concluded agreements.
The holder of the border crossing permit has the obligation to have the document permanently on their person, not to alienate it and to present it to the enforcers of the competent authorities whenever it is requested.
The holder of the border crossing permit is obliged to notify the competent border police authorities about the theft, loss, damage or destruction of the small traffic permit within 5 days from the occurrence of any of these situations.
The small border traffic permit can be canceled in the following situations:
a) it is subsequently established that foreigners did not meet the conditions stipulated in the agreements governing the legal regime on small traffic at the common border at the time of requesting the border crossing permit;
b) foreigners have obtained the border crossing permit based on false documents or information;
c) foreigners have introduced or attempted to illegally introduce other foreigners in Romania or have facilitated their transportation or accommodation;
d) foreigners have violated customs or state border regulations;
e) Foreigners entered Romania in the period of interdiction previously ordered.
The measure of revoking the small border traffic crossing permit may be ordered in the following situations:
a) foreigners no longer fulfill the conditions required for the issue of the small border traffic crossing permit;
b) after granting the foreigner the small border traffic crossing permit, they are declared undesirable or the measure of ban on entry into Romania has been ordered against them;
c) the foreigners relapse in crossing over the border area provided for in the case of small border traffic.
The decision to cancel or revoke the small border traffic crossing permit shall be communicated to the alien, in writing, together with the reasons underlying it, by the border guards when they are at the border crossing point.
