Situations in which the Entry / Exit to / from Romania Can be Refused

The citizens of the European Union and their family members are denied entry into the territory of the Romanian State only in the following situations:

  • if he/she does not present the appropriate documents and does not prove by any other means that he / she enjoys the right to free movement and residence on the territory of Romania;

Prior to communicating the refusal to enter the territory of Romania, the person shall be given a period of time which he/she deems necessary in order to prove the fulfillment of the entry conditions or the fact that he / she enjoys the right to move and reside freely within the territory of Romania.

The Border Police will provide all necessary assistance to clarify the situation of the person concerned, including by issuing an entry visa, in exceptional cases, after examining the situation of the person concerned.

  • if they have been declared undesirable or if the measure of the ban of entry into Romania has been ordered against them;
  • there are good indications that the person in question constitutes a real threat to public order, national security or public health.

The refusal to allow entry into Romania shall be communicated by the Border Police immediately, in writing, together with the reasons underlying the disposition, indicating the competent court and the term within which the measure may be appealed.

Against the refusal to enter the Romanian territory, an action may be taken at the administrative contentious court in whose territorial jurisdiction the headquarters of the issuing body of the contested administrative act is located. The court resolves urgently, with priority, by ruling. The request shall be judged in the council chamber, by quoting the parties. The court's decision is final and irrevocable.

The introduction of an administrative litigation against the refusal to enter the territory of Romania does not suspend the execution of the measure. 

Citizens of the European Union or members of their families are not allowed to leave the country in the following situations:

  • are blamed or accused in a criminal case and a preventive measure was ordered, under the Criminal Procedure Code;
  • have been convicted and  have to serve a prison sentence.

The measure of refusal of exit ceases to be lawful if the person in one of the situations proves, with documents issued by the competent authorities, that:

  •  ordering the criminal prosecution, the cessation of the criminal prosecution was ordered or the criminal trial was terminated;
  • Executed the punishment, was pardoned, was granted amnesty or was convicted, by a final court decision, with the conditional suspension of the execution of the punishment.
