Rights and Obligations

Citizens of the European Union and the EEA, as well as members of their families who exercise their right to move and reside freely within the territory of Romania, enjoy the rights and freedoms recognized by the Treaty on European Union, such as:

  1. a) enjoys the general protection of persons and property, guaranteed by the Constitution and other laws, as well as the rights provided by the EU treaties and other international treaties to which Romania is party;
  2. b) they can move freely and can establish their residence or, as the case may be, their domicile anywhere on the territory of Romania;
  3. c) benefit from social protection measures on the part of the state, under the same conditions as the Romanian citizens;
  4. d) have the right to verify the personal data included in the official documents issued by the Romanian authorities and, where appropriate, to request the correction or removal of data that do not correspond to reality;
  5. e) they have unimpeded access to the Romanian labor market, subject to the application of the transitional measures stipulated in the Treaty of Accession of Romania to the European Union, as well as to other economic activities, under the law applicable to the Romanian citizens;
  6. f) have unrestricted access to school and training activities within the national education system. 

The dependents and the partner enjoy the rights of the family members of the European Union citizen to enter and reside on the territory of Romania under the conditions established by O.U.G. 102/2005, updated.

The exercise of a right or the fulfillment of administrative formalities by citizens of the European Union or by their family members is not conditional upon the possession of a document issued by the Romanian authorities under O.U.G. 102/2005 if, by any other means of proof, the person concerned proves that he is the beneficiary of that right

During their stay in Romania, the citizens of the European Union, as well as their family members are obliged to respect the Romanian legislation.
