Protection of personal data definitions

Personal data - any information referring to a natural person, identified or identifiable; an identifiable person is that person who can be identified, directly or indirectly, particularly with reference to an identification number or to one or more factors specific for his physical, physiological, economical, cultural or social characteristics identity;

The processing of personal data - any operation or set of operations that is performed upon the personal data, by automatic or non-automatic means, such as collection, registration, organisation, storage, adaptation or alteration, extraction, consultation, use, disclosure to a third party by transmission, dissemination or in any other way, alignment or combination, blocking, erasure or destruction;

Storage - keeping the collected personal data on any type of support;

Personal data registration system - any personal data organised structure, accessible according to some determined criteria, no matter if the structure is centralised, decentralised or distributed on a functional or geographical criteria;

Data-controller - any natural or legal person, of private or public law, including the public authorities, their institutions and territorial structures, who settles the purpose and the means of processing the personal data; if the purpose and means of processing the personal data are settled by a normative act or on the basis of a normative act, the data controller is the natural or legal person, of public or private law, who is appointed as data controller, by that normative act or on the basis of that normative act;

The person empowered by the data-controller - any natural or legal person, of private or public law, including public authorities, institutions and their territorial structures, that processes personal data on behalf of the data-controller;

Third party - any natural or legal person, of private or public law, including public authorities, institutions and their territorial structures, other than the data subject, controller or the empowered person or the persons who, under the direct authority of the controller or of the empowered person, are authorised to process data;

Recipient - any natural or legal person, of private or public law, including public authorities, institutions and their structures, to whom data are disclosed, whether a third party or not; the public authorities receiving data in the context of a special competence to investigate will not be considered recipients; Anonymous data - data which, due to their specific origin or specific manner of processing, cannot be associated to an identified or identifiable person.
