International sanctions
The international sanctions
- represent the restrictions and the obligations in connection with the governments of some states, with the non-statal entities or physical or legal persons, adopted by the Security Council of the United Nation Organization, by the European Union, by the other international organizations or through unilateral decisions of Romania and of other states, in order to maintain the peace and the international security, to prevent and counter terrorism, to ensure the observance of the human rights and fundamental freedoms, to develop and to consolidate the democracy and state of law and to fulfill other purposes, in accordance with the international community objectives, the international law and with the European Union law;
aim, in particular, at blocking the funds and the economic resources, commercial restrictions, restrictions regarding operations with products and technologies with dual use and operations with military products, travel restrictions, transport and communication restrictions, - communications, diplomatic sanctions or in the technical-scientific, cultural or sports fields;
are a tool to counter the terrorism and to repress the infringements of international law or of the human rights.
Within common foreign and security policy, European Union applies restrictive measures as a means of fulfilling the objectives of the Specific Common Foreign and Security Policy, established in the European Union Treaty.
As a European Union member state, Romania applies the international sanctions imposed through the Common Positions adopted within The Common Foreign and Security Policy.
Community sanctioning regimes either undertake the decisive measures at the level of the Security Council of the United Nations Organization, or comprise the restrictive measures established by The European Union Council, autonomously.
Internally, the states have the obligation to create the juridical and institutional framework necessary to the efficient application of these measures.
According to the Emergency Ordinance No 202 of December 4, 2008 on the implementation of the international sanctions, the Romanian Border Police applies, according to the legal competences, the international sanctions concerning, in particular, the travel restrictions imposed at the U.N.O. and E.U. level.
