From the cases recorded at the level of road border crossing points  it was ascertained that there are citizens who present, in order to enter or exit the country, driving vehicles and trailers with temporary or trial license plates, issued by the authorities from the Federal Republic of Germany, and type P license plates issued by Hungary (cases which arise the criminal liability of the driver), for which the General Inspectorate of the Border Police reminds the legal provisions in this area and the way in which the border formalities are carried out for such vehicles:
Thus, according to Article 1 paragraph (3), Article 82 paragraph (2) and Article 109 paragraph (1) of Government Emergency Ordinance no 195/2002 concerning the traffic on public roads, republished, with subsequent modifications and completions, putting into circulation and/or driving a vehicle on public roads in Romania which has one of the license plates mentioned above, arises the criminal liability according to the provisions of Article 334 of Criminal Code (putting into circulation or driving an unregistered vehicle):
temporary license plates with black characters in which the validity period is written on the right side on the yellow background, issued by the German authorities, with which the vehicles can circulate exclusively on the German territory; professional license plates (garage) issued by the German authorities are valid on the territory of another state only based on a bilateral agreement concluded between the two states, but between Romania and Germany there is not concluded such an agreement; type P license plates (trial) are issued by Hungarian authorities to commercial societies which produce, trade or fix vehicles and not for the vehicles on which they are applied to, so these vehicles are not registered in circulation in Hungary.Upon the presentation of a person at the entry in the country driving a vehicle or a trailer having the license plates above-mentioned, the Border Police shall not allow the entry in the country of the transportation mean, as a result of the fact that those vehicles are not allowed to circulate in Romania.
If a person presents at the exit from the country driving a vehicle registered under the conditions presented above, the border guards shall draw up criminal file for committing putting into circulation or driving an unregistered vehicle, referred to in Article 334 of the Criminal Code.
By exception, the entry or exit in/from the country of the vehicles or trailers will be allowed, only if they are transported in transportation means (trailers, etc).
