"Congra" Operation

A Turkish citizen, stated as undesirable in Romania due to his membership in terrorist organizations, was caught by the border policemen within General Inspectorate of Border Police, with the support of the employees from General Directorate for Information and Internal Protection, while he was trying to exit illegally Romania, hidden in a freight vehicle, together with other 11 co-nationals.

Investigation

During April 2009, specialized officers within the Directorate for Countering Illegal Migration and Cross-Border Crime from the General Inspectorate of Border Police were informed by the employees within the General Directorate for Intelligence and Internal Protection, based on the collaboration between the two institutions, regarding the existence of some information according to which on the Romanian territory there is a Turkish citizen, suspect of belonging to a terrorist organization, who intends to exit illegally the country in order to arrive in Austria.

Immediately informative-operative operations started and the Turkish citizen, Huseyin C., aged 39, was identified in Bucharest.

The person involved requested granting refugee status in our country and after carrying out the specific procedures, according to the decision of the Court, he had to leave the Romanian territory until 15.06.2009, being declared undesirable due to the membership in terrorist organizations.

As a result, a restrained officers’ collective within the General Inspectorate of Border Police and the General Directorate for Intelligence and Internal Protection monitored the activities of the Turkish citizen, in order to ascertain his plans and thus to establish the legal measures.

From the investigations carried out, it was established that, during June, he intended to leave to the Western border of the country where, with the support of some of his co-nationals, he intended to cross fraudulent the border in Hungary. To this end, the Turkish citizen paid to a co-national the sum of 2.000 Dollars, following to be boarded in a TIR to exit illegally Romania.

Route

On 24.06.2009, the Turkish citizen travelled by train from Bucharest to Deva, where he lodged, waiting to be boarded in a transportation mean in order to exit illegally the country.

On 25.06.2009, the Turkish citizen got in a TIR registered in Germany and went at approximately 30 km from Deva, to the border, where the driver of the TIR parked near another truck, also registered in Germany.

The 2 trucks moved one behind the other to a gas station situated at approximately 3 km from Varsand Border Crossing Point, where both drivers changed the cars between them, thus trying to mislead the authorities.

One of the trucks which was driven by a Turkish citizens, presented in order to exit Romania, through Varsand Border Crossing Point, on 26.06.2009, around 00.30. At the thorough control carried out, the border policemen did not detect special problems, reason for which he was allowed to continue his journey.

The other vehicle driven by the Turkish citizen Salim Y., aged 51, monitored by the border policemen, presented at Varsand Border Crossing Point around 04.40 and stated that he was transporting fabrics for a company in Germany.

Border control

Based on the information, as well as observing that one of the back door of the truck could be opened without affecting the customs’ seal, the border policemen carried out a thorough control of the mean of transportation.

As a result of the control, the border policemen discovered in the freight compartment of the truck, 12 male persons hidden in a place specially arranged behind the fabrics on the hangers - among them was the Turkish citizen Huseyin C.

From the first investigations it was established that the Turkish citizens aged between 16 - 42 entered legally in Romania and intended to get illegally to Germany.

Criminal liability

As a result of the ascertained facts, the 12 migrants are investigated for committing illegal crossing of the state border, following to be brought before the prosecutors in order to take the legal measures.

At the same time, the driver of the freight vehicle is investigated for committing trafficking with migrants. The investigations are continuing in order to detect the persons implied and to establish the entire criminal activity.

The Turkish citizen, Huseyin C. was detained and for the finalization of the case the legal measures will be taken against him.
