Starting on August 20, 2012, Law 247/2023 enters into force, which complements Law 248/2005 regarding the regime of free movement of Romanian citizens abroad. Thus, minor Romanian citizens who have reached the age of 16 can travel abroad unaccompanied, with the consent of their parents or legal representatives, under the conditions of this law.
Specifically, the minor who has reached the age of 16, holder of an individual travel document or, as the case may be, an identity card, simple identity cards or electronic identity cards, can travel abroad unaccompanied, in the next three situations:
- to visit relatives.
- for studies or to participate in official competitions.
- to follow a medical treatment without which his life or health is endangered.
Depending on the declared purpose when leaving the country, the minor who has reached the age of 16 must present the following documents to the border control:
For traveling to visit relatives:
- an authenticated declaration of both parents or, as the case may be, of the parent to whom the minor was entrusted or whose domicile was established by a final court decision or a notarial agreement, as the case may be, of the parent who alone exercises parental authority pursuant to a court decision remained definitive, of the surviving parent or his legal representative, which includes their agreement regarding the minor's respective trip, in the destination state or states, the period in which the trip is to be carried out, as well as the purpose of the trip (to result expressly that the trip is made to relatives).
We specify that the authenticated statement of the parents must be presented in the original when leaving the country and not in electronic format, as it cannot be verified by the border police by accessing a database legally set up for this purpose.
For traveling to study or to participate in official competitions:
- an authenticated declaration of both parents or, as the case may be, of the parent to whom the minor was entrusted or whose domicile was established by a final court decision or a notarial agreement, as the case may be, of the parent who alone exercises parental authority pursuant to a court decision remained definitive, of the surviving parent or his legal representative, which includes their agreement regarding the minor's trip in question, to the country or countries of destination, the period in which the trip is to take place, as well as the purpose of the trip ( to expressly show that the travel is carried out for the purpose of participating in studies or official competitions);
- supporting documents regarding the minor's participation in official studies or competitions abroad, issued by the organizing institution, showing the period and the state or states in which the official studies or competitions will take place.
In order to undergo a medical treatment without which his life or health is endangered:
- an authenticated declaration of both parents or, as the case may be, of the parent to whom the minor was entrusted or whose domicile was established by a final court decision or notarial agreement, as the case may be, of the parent who alone exercises parental authority pursuant to a court decision remained definitive, of the surviving parent or his legal representative, which includes their agreement regarding the minor's trip in question, to the country or countries of destination, the period in which the trip is to take place, as well as the purpose of the trip ( to expressly result that the travel is carried out for the purpose of following a medical treatment);
- documents proving the minor's medical condition, issued or endorsed by the Romanian medical authorities, showing the period and the state or states in which medical treatment is to be provided.
